Bare truth unloads: 'Dishonest' Zaki 'Lied




Former Chief Justice Zaki Tun Azmi took time from his RM2.2 billion job as a road builder to offer us some pearls of wisdom about the judiciary.
He says that when he was the CJ he never received any calls from the PM or other members of the executive. In other words, the judiciary in Malaysia is independent, said the former Umno lawyer.
Yes, we believe you. The power grab in Perak and the decision by the highest courts of the land to thumb their nose at longstanding precedents laid down by Malaysian judges pre-Mahathir era really does smack of independence.
Anyway, Zaki says that the decision by the court to acquit Anwar is proof that the judiciary is independent. Actually the jury is still out as to why Anwar was acquitted. The evidence was flimsy from start but the High Court judge went from being so sure of the accuser at close of prosecution’s case to suddenly having cold feet about the veracity of his evidence.
Only the judge and His Maker really can tell us what happened.
Zaki should perhaps do a check and find out if the Opposition or if the likes of Bersih win cases in court anymore, or if they even get leave to argue their cases.
Anyway, should we expect a person who has obtained a hefty road contract, the Kinrara Damansara exchange, and the plum position of head of civil service commission, to say anything worthwhile.
In case anyone forgot, Zaki’s partner as a roadbuilder is Umno lawyer Hafarizam Harun.



the petition of appeal filed on 11.7.12 by the Attorney-General's Chambers against the acquittal of opposition leader Datuk Seri Anwar Ibrahim in the Fitnah II trial.We are shocked that the A-G has proceeded with this appeal despite High Court Judge Zabidin Mohd Diah's clear factual finding of evidence-tampering by police.This proves that the filing of the petition of appeal is politically motivated and and an attempt to jail Anwar before the 13th general election. Judge Zabidin Mohd Diah had found that the investigating officer had cut open the evidence bag (P 27) against all legal and investigative procedures and that the seals used were not tamper-proof.
The judge also strongly emphasised that there could be no confidence in the integrity of the samples. In the normal course of events the Court of Appeal would not interfere with these clear findings of fact.The appeal is thus a deliberate misuse of prosecutorial powers and shows the extent to which the A-G's Chambers has been undermined and compromised by Najib and Umno-BN.Appeal can't get through without approval from Najib & UmnoThe evidence-tampering shows that there was an attempt to fabricate evidence against the parliamentary opposition leader and supports the defence case that there is a political conspiracy to taint and imprison Datuk Seri Anwar Ibrahim.Despite the pretence of democratization and reform, this appeal proves that Najib Razak is an unprincipled and authoritarian leader who will stop at nothing to cling on to power.The prosecution of Anwar cannot happen without the approval and involvement of Najib and Umno-BN. Malaysians love to talk. As so many of my friends in Malaysia know, I have been very outspoken in support of Anwar’s freedom for over one decade. And that is because I know the truth. I was there when it happened the first time.
In 1998 – the first time around for Anwar – my Embassy heard and reported lots of things. We knew the truth. Because Malaysians – at the highest levels -- told us.
 Najib’s personal think tank was called the Malaysian Strategic Research Centre, or MSRC. MSRC basically was two people, Rohanna Mahmood and Razak Baginda.
Neither Rohanna nor Razak are government officials, so I am not violating any US laws by revealing what they told me and my Embassy in those days.
In 1998 Rohanna joined me for a private one-on-one luncheon at the Ambassador’s residence. It was during the time when Anwar was starting to challenge Mahathir, subtly but still obviously.
Rohanna told me that Najib and Anwar had reached a secret agreement. When Mahathir was gone, Anwar would be PM and Najib would be Deputy PM. That was the deal.
That never happened, of course. When the going got tough, Najib stood by, and let Anwar go to jail.What about Razak Baginda? a senior Embassy officer, “The decision has been made. They are going to “nuke” Anwar politically for all time to come. “Until he can never stand up again politically.”Meaning, it was all a political decision – to destroy Anwar.

Setev's words are not only loud and clear for all to hear but have deep implications for Malaysia, which has been dragged into the centre of the 6-year-long global scandal. If Najib doesn't dare to defend his own name, then he must be hiding something or is even guilty of the damning allegations made against him. This is what Setev is saying.
And if this is so, then Malaysians may have to finally rouse themselves into action and demand the resignation of their scandal-tainted prime minister if he refuses to come clean and be responsible to them and the global community.
Shocking silence, a sign of guilt?
In a press statement issued to the Malaysia media on Thursday and read out at a press conference by PKR MP for Kelana Jaya Loh Gwo-Burne, Setev said it was shocking that the Najib administration had not taken any interest in assisting or participating in the Scorpenes probe.
His 28-year-old daughter is believed to have been killed because of her knowledge of the Scorpene submarines deal, in which French vendor DCNS has been accused of bribing officials including Najib to seal the RM7.3bil sale to the Malaysian government.
Setev also expressed shock that the Malaysian Parliament - which is controlled by Najib's Umno party - had rejected a recent motion to debate new evidence uncovered in the French trial that indicated Najib's close friend and Scorpenes negotiator Razak Baginda may have sold military secrets to DCNS.
"Due to the murder of my daughter, I have taken a keen interest in the Scorpene trial in the French Court. The latest developments have seen information regarding a Hong Kong company named Terasasi whereby Razak Baginda and his father are directors, being implicated in the selling of military secrets to a French company," said Shaariibuu.
Sweeping dirt under the carpet
DCNS is now on trial in Paris for corrupt dealing in the Malaysian Scorpenes purchase. French police have uncovered hundreds of documents which are still being assessed by the French court. So far, the money trail established for the payment of the Scorpenes bribe has led to Baginda, whom many regard as Najib's front man, and Umno.
Nonetheless, Malaysian authorities including current Defense minister Zahid Hamidi and top military officials have denied naval secrets were sold. And although such an act is high treason, no one in the Malaysian government has dared to call for an investigation. Their nonchalant sweeping of the dirt under the carpet has sparked public indignation and anger.
Some political watchers say Najib and Umno will have to keep closing an eye and repeating their denials because the country's 13th general election is due to be held soon. To Altantuya's dad, that might be trivializing his daughter's murder, but by sitting on both the Scorpene and Altanutya cases, Najib is courting serious trouble and loss of voter confidence in his personal integrity.
We have proof Altantuya traveled to France
Setev also refuted the slew allegations spun by the Umno-controlled Malaysian media that Altantuya did not travel to France between 1999 and 2007. The Scorpenes were bought in 2002 and Altantuya was killed in 2006.
"We have proof that she did indeed travel to France and will produce the evidence if so required. I hope that through this case and efforts of other good people in France and Malaysia, we will get to the truth and hopefully find the real masterminds behind my daughter's murder," said Setev.
Setev, who added that he was willing to assist in the Scorpene probe and could provide useful information that would bring more clarity to the case, is alread on the list of witness due to testify before the French court.
Intertwined - Altantuya and Scorpenes
Deliberately misreporting, the Malaysian media had cited French immigration records and insisted that these showed she had not entered France. However, the latest court documents showed that she actually did so, bolstering Setev's claim. There is also testimony from a DCNS official saying that he had met her and she was known to him as Baginda's interpreter.
The reasons are obvious why Najib and Umno would go all out to de-link the Altantuya murder from the Scorpenes deal. In the Scorpenes case, at the most, Najib and Umno could be found guilty of only graft.
However, once the connection between the Scorpenes purchase and Altantuya is established, it would be difficult for the Malaysian courts to refuse to re-open the case. There might even be a re-trial if the evidence uncovered in France is deemed significant and central to the motive behind her murder. Najib and top Umno officials might find themselves on the list of new suspects.
Urged to extend full co-operation to Mongolian investigators
Setev also appealed to the Najib administration to extend "full and sincere" assistance to a Mongolian working team due to arrive in Kuala Lumpur to investigate Altantuya's murder.
Altantuya, who speaks 4 languages including Russian, was shot in a jungle clearing in Shah Alam by two of Najib's former bodyguards. They also blew up her body with restricted-for-military-use C4 explosives so as to prevent identification. While the two cops have been sentenced to hang for the murder, there is obvious public dissatisfaction with the outcome.
Firstly, Baginda was controversially acquitted of having abetted in the murder. He was seen as having been let off easily, without the full story being dragged out from him by either the police or the prosecutors. Secondly, the majority of people following the case believe that the real master minds behind the killing have yet to be exposed.
"I hope for the sake of justice and mutual relations between Mongolia and Malaysia, that the Malaysian government will provide full and sincere assistance to the Mongolian working team which will be arriving in Malaysia this August to investigate the murder of my daughter."
There are several conflicting details regarding slain Mongolian national Altantuya Shaariibuu, which has come to light following claims by French police that she never entered France from 1999 t0 2006.
Najib Razak is a liar and that he was deeply involved in Scorpene Scandal and causing the death of Altantuya, which he impregnated despite his repeated denials and even trying to exonerate himself by telling the public that he swore that he knew not Altantuya by swearing on the Koran in a mosque more than once. But who had seen him swearing? What a pathological liar Najib Razak is and how can we have such a PM for our country? Altantuya Shaariibuu is but an incidental collateral damage in the Scorpene scandal. If she didn’t push her luck too far, she would have been alive today and would be enjoying whatever ‘commission’ reaped from the scandalous deal. That would make her an accomplice in swindling the Malaysian taxpayers’ money. While I do strongly condemn the heinous crime committed against her ( and the alleged unborn baby), the core of the matter is for us not to lose sight on the money plundered and to bring the criminals to book of law.If there is no record of Najib and Razak being in France is because both traveled on diplomatic passports and landed at a private airport using a private plane. As for Altantuya, well a well traveled UMNO lawyer would have paid people in France to delete the records or they got deleted by the system after a number of years. Since Razak claimed to have met her there, she must have been in France. Besides with the Schengen Treaty, there are no immigration controls in the participating EU countries except at the point of entry. Najib, Razak and Altantuya could have entered France from Germany, Belgium, Luxembourg or Switzerland and there would be no record of their entry. Suaram should check with the immigration authorities of neighbouring countries. Identity and question the party that threatened Bala’s life and that who paid the two SAF men to kill Altantuya, and the case can be solved. That is simple logic. It is impossible for the judge presiding over the case to not know that.

Mysterious French operative at center of massive arms scandal
Last week, a Maltese politician dropped a bombshell into the investigation of allegations of kickbacks in the sale of French submarines to Malaysia, saying French prosecutors were on the trail of a soft-spoken Frenchman named Jean-Marie Boivin and his Malta-based company, Gifen.
Boivin, according to a plethora of news stories in France and Luxembourg, is at the heart of a scandal that stretches across half the earth to Pakistan, Taiwan, Malaysia, India and untold numbers of other countries whose defense ministries bought armaments from the French defense giant DCNS around the turn of the century. At least three of those sales have been dogged with stories of bribery and the murder or unexplained deaths of 19 people. According to other revelations, the sale of submarines to India is also suspected of “non-compliance” with the OECD Convention on Bribery.
Paris Match reported on Nov. 24, 2010, in a story titled Boivin, Celui Qui Fait Trembler le Republique (Boivin, the Man Who Shakes the Republic), that Boivin was “at the head of a myriad companies in tax havens.” Other news media reported that “outlandish commissions” travelled through what were described as a galaxy of companies, including gifts to the former security chief of onetime Chilean strongman Augusto Pinochet for the sale of two submarines to Chile.
According to the news stories, Boivin, described as “a quiet man, even mysterious, multilingual, with a quite surprising international network of relationships,” operates in the very top European circles. He accompanied the Grand Duke and Duchess of Luxembourg on a state visit to Brazil two years ago. Other reports say he was a friend of Luxembourg Prime Minister Jean-Claude Juncker and former Minister of the Interior Michel Wolter, inviting them on a South African safari at DCN expense.
The French government signed the OECD Convention on Bribery on July 31, 2000, which calls for fines of €150,000 and, according to the convention, “shall be punishable by effective, proportionate and dissuasive criminal penalties….comparable to that applicable to the bribery of the (signatory country’s) own public officials and shall, in the case of natural persons, include deprivation of liberty sufficient to enable effective mutual legal assistance and extradition.”
Did DCNS decide that the way around the bribery convention was to put space between France and the countries to which it was selling weapons? If so, that space appears to have been occupied by Boivin, who left DCNS after heading the defense company’s international financial operations from 1994 to 2004 to establish a tangle of companies in the Isle of Man, Malta, Ireland, Switzerland, Mauritius, the Bahamas, the British Virgin Islands, the Caymans and other principalities that have never signed the convention.
When his Luxembourg-based company Eurolux – which allegedly was established through DCN and is also under investigation by French prosecutors – was on the edge of bankruptcy, according news reports, Boivin wrote letters to Nicolas Sarkozy, Michele Alliot-Marie, then the defense minister, and President Jacques Chirac, saying he had explosive letters in a safe in Zurich, Switzerland. The letter, described as “friendly but determined,” was on the theme “Retain me, or I do something.” Apparently it worked. Boivin, according to several other publications including Le Nouvelle Observateur, was paid €8 million by DCN.
“To believe documents seized by the courts,” according to Paris Match, “the galaxy of shell companies…served, among other things, to settle contract commissions for Agosta submarines sold to Pakistan, part of which, according to statements by former Defense Minister Charles Millon and former Prime Minister Dominique de Villepin, could be returned to France in the form of kickbacks.”
Despite Sarkoxy’s denials, documents in the DCN files show that the former French President, as Minister of the Budget in 1994, had agreed to the creation of at least one of Boivin’s companies, the Luxembourg-based Heine, which was central to the Pakistan case.
In what has become known as L’Affaire Karachi, in which Pakistan bought the three Agosta-class submarines from a DCN subsidiary, 14 people including 11 DCN engineers were killed when the van in which they were riding was hit by a bomb that at first was said by Pakistani officials to have been set off by Al Qaeda operatives.
It later transpired that, according to investigations by the anti-terrorist judge Marc Trevidic in Paris, the bomb was the work of Pakistani officials who were outraged when Chirac, after he defeated Edouard Balladur for the French presidency in 1995, blocked kickbacks, some of which reportedly went into Balladur’s campaign. Sarkozy at the time was Balladur’s campaign manager. The former French president, who was defeated in national elections last month by Socialist Francoise Hollande, has repeatedly denied any knowledge of the kickbacks.
Boivin is also said to have been involved in the sale of six Lafayette-class frigates to Taiwan, a deal so lucrative that some US$600 million paid in commissions on the US$2.8 billion contract disappeared into various Swiss accounts established by Andrew Wang Chuan-pu, the Taiwan agent for the French company Thomson CSF, now Thales, a unit of DCN. Wang abruptly left Taiwan when the matter began to leak into the public and has never been seen or heard of since.
Two years after the contract was signed, the body of a Taiwanese naval captain, Yin Ching-feng, was found floating off the coast, a victim of foul play. Although Taiwanese authorities said he had died by drowning, an autopsy ordered by the family found he had been battered to death. Among those who have also died since 1993 were Thierry Imbot, a French intelligence agent who was assigned to watch the frigate deal for the French secret service and who fell to his death from his Paris apartment. A year later, a former Taiwan-based Thomson executive named Jacques Morrison, who told associates he feared for his life because he was a witness to the talks, also fell or was pushed to his death. Yin’s nephew also died under unexplained circumstances.
The French government blocked all inquiries into the affair by judicial officials who were unable to obtain relevant documents. In October 2008 the judge finally ruled that no one could be prosecuted because of lack of evidence. Thus the case was finally closed on huge payoffs to high ranking French politicians – and on suggestions that Communist party officials in Beijing had been induced to mute criticism of the sale of arms to Taiwan in return for hundreds of millions of dollars in bribes. Roland Dumas, who was foreign minister at the time and changed French policy to allow the frigate sales at the urging of a mistress who was being paid by another French company, has implied that he knows where the money went.
Ultimately, the Paris-based International Court of Arbitration, an offshoot of the International Chamber of Commerce, ruled in 2010 Thomson-CSF, which has since changed its name to Thales SA had spent over more than $500 million on bribes to secure the deal. Taiwan is suing for another US98 million.
The final case is that of Malaysian Prime Minister and former Defense Minister Najib Tun Razak and the purchase for US$1 billion of two Scorpene submarines from the DCN subsidiary Thales by Malaysia, with a €114 million commission paid to a shell company wholly owned by Abdul Razak Baginda, at the time Najib’s best friend. Razak Baginda’s onetime mistress, the Mongolian translator and party girl Altantuya Shaariibuu, accompanied Baginda on at least one trip to France dealing with the training of the submarine crews. DCN also paid a Hong Kong company owned by Razak Baginda and his father €39 million for a document allegedly describing the Malaysian military’s specifications for the submarine purchase.
Altantuya was murdered by two of Najib’s bodyguards at the direction of unknown persons after she had flown to Kuala Lumpur to demand US$500,000, which she termed “blackmail” in a letter found after her death in September of 2006. The French law firm headed by William Bourdon and representing the Malaysian NGO Suaram, said that Gifen had intervened in negotiations over the submarines “so as to facilitate the money transfers in this case,” and particularly to finance the trips of Baginda and Altantuya.”
As for Boivin, he has since taken out citizenship in Luxembourg. He was summoned by French magistrates in June of 2010 but he did not show. He was eventually indicted. However, he remains free although he has said he would cooperate with authorities. When his lawyer, Philippe Lauzeral, was asked if the €8million requested in his letters to Sarkozy and others was paid for his silence, Lauzeral answered: “False. There have been discussions, but no financial agreement has been formally signed. My client is very upset by what he reads. It is not the deus ex machina that is presented. He merely carried out orders from his superiors in the DCN, which is a state enterprise. It is the feeling of having served his country.”
PKR vice-president Tian Chua alleged today that one of the 153 leaked French investigative documents confirmed that military information was given to the French company Thomson CSF (later known as Thales International Asia), which eventually became DCNS, the shipbuilding company that sold Scorpene submarines to Malaysia.
Tian, the Batu MP, said that this would refute Defence Minister Ahmad Zahid Hamidi’s denial that classified documents had gone out of the country.
He showed reporters in Parliament a copy of a translated three-page “Document 97″, which he said was a police summary of various proofs that they have collected, and were arranged according to at least 128 sections.
In one section, Tian said the police had seized a report which Terasasi Ltd (Hong Kong) had handed over to Thomson CSF Asia. The report had “listed down competitors of the French proposal (Holland, Germany, Turkey, Russia and South Korea)”.
“The analysis of the different strengths of these competitors was quite detailed. The most serious competitor was South Korea with an approach technique different from that of Perimekar Sdn Bhd, addressing directly the Malaysian Navy. Perimekar’s strategy was to promote the French proposal to decision-makers (different ministers and military officials),” read the document.
Interpreting the document, Tian alleged that these reports were the Malaysian military analysis on the strength of each of the proposals from each country.
“This means the military had received the proposals from these countries and had studied them to see which ones were good, which ones had weaknesses, and which ones had problems. That was an internal evaluation. Terasasi got this [information] and gave it to the French side. The strategy was for the French to get the contract,” he alleged.
“So this is what we mean by breach of national security. Perimekar, being a Malaysian agent, shouldn’t have taken part… Malaysian agents were promoting the French [proposals] while our military was still studying which was the best option.”
Something seriously wrong
Terasasi and Perimeker were both owned by Abdul Razak Baginda, said to be a close associate of Prime Minister Najib Tun Razak.
Tian said that South Korea had “slightly different” specifications but (their proposal) was cheaper. “So what happened was that Perimekar, under Razak Baginda, sent all this information there [Thomson] so that the French could get up to the [top] spot”.
“This document clearly shows that there is something seriously wrong with our defence procurement. And this was only one of the many documents sent to Thomson.”
Tian questioned how Terasasi obtained the report on the different countries from the Malaysian navy as it was not part of any ministry but merely a private company and accused it of possibly committing treason.
“How did Terasasi got this [information]? It is not the defence ministry, it is just a private company. Not only did they get [this confidential information], they also sent it to the French who had an interest in it,” he said.
“To get paid for what they were reporting to Thomspon, that is treason. This is part of the secret
documents. The French police themselves recognised this.
“Imagine this: the French were entering a trade, knowing all their competitors’ information, this is espionage. If the French themselves went to Turkey and South Korea, and stole the information, [that's different]. But now, Terasasi is the one which supplied them. I’m asking how could Terasasi obtain this information?”
Tian said this was serious and the government cannot continue denying but must start an inquiry.
‘Umno biggest beneficiary’
“If Zahid said that he doesn’t know, it is only because he was not the defence minister at the time. But it would be dishonest of him not to find out about all these things.”
Tian said that Zahid, former premier Dr Mahathir Mohamad or Najib must now answer “why they went for the French option” and “why they allowed and nominated so many of these companies which, in the eyes of the French, were to benefit Umno, the ruling party.”
Comparing the Malaysian government’s attitude and the French court’s actions, Tian said the court in France spent two years and unearthed so much, while the Malaysian government was denying there was even a court case, saying “we don’ care, we won’t cooperate with you”.
Other parts of the Document 97 also detailed the French police’s notes, which stated that usually “the ruling party [Umno] is the biggest beneficiary” in major defence contracts.
It said that major defence contracts in Malaysia required important local content called “Malaysian Industrial Participation”, which is typically a powerful local industrial partner or a joint venture with a less significant local company.
Tian said this was called “taxi companies” such as Perimekar and Terasasi.
Another paragraph read: “In the early 2000s, Thales and DCNI [a subsidiary of DCNS] were about to form a 50:50 joint venture between Thales Naval and DCNI. Under pressure from the French government, they decided to join forces in Malaysia for the submarine project.
“Thales International was specially tasked with buoying the political network because it was perceived as having the best political/industrial connections in Malaysia (compared to DCNI). Senior management members of Thales had a meeting with a Malaysian diplomat, who led them to choose Razak Baginda as a point of reference for the political network.”
‘Small companies disappeared’
The document also listed a series of companies nominated by the Malaysian government to receive benefits, including Perimekar.
Summarising the details, Tian said eventually “the small, small companies disappeared and finally there were two companies left, Terasasi and Perimekar. Terasasi directly received payment from the
French side, while Perimekar got directly from the Malaysian side… it was 114 million euros from Malaysian side. Terasasi signed various agreements starting with Thompson, which finally became Thales and DCNI”.
Yesterday, Tian accused the government of lying over the controversial Scorpene submarine deal and that Zahid could be hauled up for contempt of Parliament.
On Tuesday, close to midnight, Zahid denied the alleged sale of classified documents as there was “no information on the allegation”.
Terasasi was alleged to have received 36 million euros (RM142 million) from DCNS for, among others, the “sale” of a highly confidential report comprising the Malaysian Navy’s evaluation for the order of the submarines.
He also said that there was no need for an independent commission to investigate the purchase of new Scorpene submarines as the vessels were accquired according to National Defence
Equipment Procurement procedures.
He said the government also found it unnecessary to be an observer at France’s “Tribunal de Grande Istance” Court as it understands that there is no trial taking place in the country on the Scorpene
submarine issue.
Zahid stressed that the ministry never paid any commission directly or indirectly to any companies in the procurement of the submarines.
The RM7.3 billion deal to purchase two Scorpene submarines with DCNS and Spanish Navantia was inked in 2002, when Najib was defence minister.
In 2009, Suaram successfully sought for a judicial inquiry at the Tribunal De Grande Instance in Paris to probe alleged corruption crimes and illegal bribes involving top officials from both Malaysia and France in the submarine deal.
Suaram claimed that DCNS had paid bribery amounting to 114 million euros to Perimekar, with help from Mongolian national Altantuya Shaariibuu, who was later gruesomely murdered for allegedly asking a part of the bribe
Under the French justice system, an investigative judge has the power to perform both as a judge and investigating prosecutor.‘If Zahid is right, then Malaysian courts have no right to try foreigners accused of committing crimes under Malaysian law.’ Zahid should stop worrying about Ambiga or BERSIH. He should be more woried being summoned by the French Court. He talked big before, thinking the French Court is like French fries which he can chew
