WHAT DID HE MEAN BY ‘TENTATIVE CHARGE BUT ALL IS NOT LOST’?

On 11th October, Malaysia Today carried a post entitled ‘Abuse of power by the Deputy Prime Minister’ that laid out a series of sms’es alleged to have passed between Najib and senior lawyer Shafee Abdullah in relation to Razak Baginda’s arrest and remand in the days before Baginda was charged.

Najib was publicly asked to comment about these sms’es and he never denied the authenticity of the same.

Now, there’s one other exchange of sms’es, this time allegedly between Razak Baginda and Najib. I do not recall Najib himself having ever addressed or denied or admitted the correctness or otherwise of these sms’es directly, as he did with the series of sms’es referred to in the MT posting.

I am referring to the 2 sms’es mentioned at paragraphs 51 and 52 of the first statutory declaration of private investigator Balasubramaniam. Let me reproduce below both paragraphs 51 and 52 of that first statutory declaration.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30am. Abdul Razak Baginda informed us that he had sent Najib Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30am, Abdul Razak Baginda received an SMS from Najib Razak and showed, this message to both myself and his lawyer. This message read as follows: “ I am seeing IGP at 11am today … matter will be solved … be cool”.

Shareholder dispute revives Scomi past

A YET-TO-BE publicised shareholder dispute involving the son of former prime minister Abdullah Badawi is likely to renew debate over Malaysia’s role in the clandestine trade of sensitive military technology.

Sri Lankan businessman Buhary Syed Abu Tahir has gone to the High Court to claim RM75 million (S$31 million) from the former premier’s son, Mr Kamaluddin Abdullah, and another businessman, Mr Shah Hakim Shahzanim Zain.

In the suit filed by his wife late last year, Mr Tahir is demanding what he claims is money owed to him for his equity interest in engineering company, Scomi Group, lawyers familiar with the case told The Straits Times

What I want to reveal here is that when I was in Kamunting for almost two months from September to November 2008, I did some probing. You know me: I love probing — as long as it is not the butt of a Havana Club hostess. Anyway, what I discovered in my probe is most interesting indeed.

I found out that Buhary Syed Abu Tahir a.k.a BSA Tahir did not spend his entire time in Kamunting. They did send him there when they first detained him under the Internal Security Act (ISA) but a short while later they came back for him and he ‘disappeared’.

Four years or so later, Tahir suddenly returned to Kamunting and a few days later he was released. Tahir is probably the first person in Malaysia to be detained under the ISA in Kamunting but not actually have to spend time in Kamunting.

I did more probing and discovered that during the time he ‘disappeared’ from Kamunting, Tahir was ‘detained’ in an exclusive condo in Bangsar. That was how he ‘suffered’ his four years detention.

The reason why Tahir was detained but not Kamal or Shah Hakim was never really explained other than the excuse that Tahir did things behind their backs which they were not aware of. Now it seems they were more than aware. They were in fact part of the ring.

Okay, while we wait for the Malaysian mainstream media to pick up this story (if they dare), let us move on to PI Bala. Bala is still awaiting the confirmation of the interview that the MACC wants to have with him. MACC, however, is yet to decide when and where they would like to meet Bala even after so many months.

Do I detect some reluctance on the part of the MACC? Is the MACC trying to avoid meeting Bala? Why is the MACC so scared of meeting Bala? What is it that Bala is going to say that has put the fear of God in the MACC?

Over the weekend, Raja Petra Kamaruddin of Malaysia-Today has come up with several revelations in the case of the sodomy allegations against Anwar Ibrahim (forgive this very lazy kind of blogging).

Here’s some interesting points, in case you cannot access Malaysia-Today.

Who is Rodwan, and why the secret meeting in Room 619?

According to RPK, Saiful Bukhairy had met a police “conspirator” – Senior Assistant Commissioner (SAC) II Mohd Rodwan Mohd Yusof – before the former lodged a police report against Anwar Ibrahim on 26 June. The secret meeting took place in Room 619 of the Concorde Hotel on 25 June. Both men had spoken about 8 times on the phone.

[Rodwan was the same police officer who was involved in fabricating the 1998 sodomy allegation against Anwar Ibrahim. He was allegedly the man who illegally took Anwar’s specimens, which subsequently mysteriously reappeared as ‘stains’ on a mattress].

What do you tell Malaysians who are impatiently waiting for the outcome of these allegations?

There’s more kinky sex during the trial which will put Astro out of business. That Malaysians will eventually come to know who Mumtaz Jaafar is and what her ‘special’ links with Rosmah are. Further to that, Malaysians will be told about the relationship between Najib’s Special Officer, Khairul Anas, and Saiful — “and the less than manly reputation these two buggers had while still in school. Yes, the excitement and kinky sex that is going to spill over from this trial will cause Astro to lose a lot of business”.

Will Anwar be arrested within these few days and why?

RPK claims that Abdullah Ahmad Badawi wants to charge Anwar because this would invariably dragged Najib Tun Razak and his wife Rosmah Mansor, aka Dotty, into the whole mess. The police have recorded both Najib’s and his wife’s statements under Section 112. So that means Najib and Rosmah would both have to take the witness stand to testify during the course of the trial.

So, this is not about Anwar but Najib?

No, this is not a case of Anwar being set up for a fall under false allegations of sodomy. It is about Najib being dragged into the mess and being fingered as the dalang behind the conspiracy to set Anwar up. Sure, Anwar will face a temporary setback. He will spend five to six years in jail and then will be declared not guilty. But Najib will be sent into retirement for good.

“This is not about Anwar. This is about Najib. And Najib has not awoken to this fact yet. Poor thing” (says RPK)

Today, the mother of all trials in Malaysian history begins. This is bigger then the Jean Pareira murder case in the 80′s. I don’t think I had much chance to read papers those days but I still remember vividly about it. This case is receiving worldwide attention. I think if this can be commercialized, the ratings would have beaten American Idol or the movie Avatar. Quoting partly what Mahathir said, ” If they can make Avatar, this is nothing.” I believe majority Malaysian will not accept what ever the prosecution wants to say. Another blogger, Steadyaku47, wrote “Fool the Rakyat once, shame on you. Fool the Rakyat twice? Shame on the Rakyat!”

I believe all Anwar supporters, sympathizers’ as well opponent is glued to the papers and to the internet. Everyone wants to know what transpired in courts. I am no exception. I don’t know how many people reads with an analytical view and how many would read and accept what is written blindly as gospel (oops! a Christian word, Muslim cannot use?) truth.

On 29/7/2008, I wrote an article under the heading“PUSRAWI Medical Report.. Did RPK err?”.
I remember I receive a lot of bashing from Anwar supporters because they cannot differentiate between “Medical Reports” and “Medical Notes” and the message I was trying to drive at. There was almost a fanatical behaviour of the readers. I concluded my writing then that the notes have not proved or disapprove anything.

Malaysiakini gave a good rendition of what transpired in court today. I took the liberty of copying an image from the article and it is displayed here for easy reference. Shown below is part of the Pusrawi Medical notes which RPK made it public sometime back. Please focus on date and time on the images. The full PUSRAWI medical notes can be read from my earlier article.

In a nutshell, Saiful went to PUSRAWI on the 28^th June 2008 and was seen at 1414Hrs with complains of Tenesmus for one week and he gave a history that he was “alleged assaulted by intruding a plastic item in anus” . There was no mention about any penile penetration occurring two days prior. This is relevant as the prosecution is claiming that Anwar penis entered MSB Anus on the 26^th June 2008 between 3:01pm to 4:30pm. If that is the case why MSB didn’t complains as such to the doctor at PUSRAWI. Maybe he was shy. Let’s give him the benefit of the doubt for now.

In the charge sheet, it was said that the prosecution found Anwar semen in MSB Anus. If my memory serves me right, MSB went to HKL after PUSRAWI where he was admitted on the same day. In other words if indeed MSB Anus was swabbed for semen then it must have been done late evening on the 28^th June 2008 or the next day. If it was done on the 28^th June, it means between the alleged sexual act and the time the swab was taken, more than 48 hours has passed What is the prosecution trying to prove here? It says that MSB did not go toilet to pass motion for 48 hours? He did not clean himself? If indeed he did not go to ease his bowels, he must be suffering from severe abdominal distension. Can man semen last that long outside a human body in another person ass? This is a simple. I suggest my readers do simple experiment and collect their semen and place it in a plate and see what happens to it in one hour. No need to wait for 48 hours. It will liquefy within a few 30 mins to 1 hour. Don’t believe me? Well do the experiment or you can read here. If the prosecution is saying that they found Anwar semen in MSB Anus after more than 48 hours after the penetration, it is certainly a miracle. If we have a good and well informed judge, I think this case is already over even before it started. At least that is how I sees it but then I am not the judge. I don’t read law.

This brings me to the question. Who is exactly is on trial here? Is it Anwar or the Government? For all the hard work Najib is putting into the country in trying to win the peoples confidence, I would say the last few days the system is working hard against him. His own close personal aide utter seditious remarks and yet he was asked him to resign. There is no indication that the police is investigating the case. Najib should have been more firm and sacked him instead of asking him to resign. Having said that, BN must think very hard. They must decide quickly as this case has a huge impact on their survival. I believe the general consensus is that UMNO/BN is digging their grave prematurely.

Mohd Saiful Bukhari Azlan, who took the stand at the High Court as the prosecution’s first witness, testified that when he first met Anwar at a condominium in Damansara Heights in 2008, the PKR de facto leader had asked him: “Can I **** you today?”

Wah! Anwar must have really been horny that day. Meeting a stranger and right away, “Can I FUCK you today?”

Saiful’s use of the profanity was greeted by sniggers and murmurs from those in the public gallery.

Well at least some people in the courtroom have a sense of humour or more likely they were tickled at hearing the word FUCK which is so often misused and misunderstood. And banned.

When asked by the prosecution about his immediate reaction to the request by Anwar, Saiful replied that at that point of time he felt “angry and scared.”

Okay, quite natural to feel that way. Of course, if somebody you met for the first time asked to fuck your ass wouldn’t you get angry?

“I was angry and scared.. I refused to do so, to which Anwar became angry,” said Saiful.

Very good.

The complainant also alleged that the former deputy prime minister had offered him money in exchange for the sexual act, to which he also “refused”.

Good. Any God-fearing man would have done the same. Well done!

HOW MANY OTHER PIES HAS THE FIRST LADY GOT HER FINGER IN?  AND WILL THIS FIRST LADY SCORE A FIRST BY BEING ASKED TO APPEAR IN THE WITNESS STAND?

All eyes are on Monday’s resumption of the Sodomy II trial, where defense lawyers acting for Opposition Leader Anwar Ibrahim are likely to ask the court to call on both DPP Farah Azlina Latif and complainant Saiful Bukhari Azlan to take to the stand over allegations they had an affair – which could jeopardize the fairness of the trial.

“I believe the defense team is still weighing the best way to move forward. But an application to probe the extent of Saiful’s relationship with the DPP may be the first step,” PKR vice president Sivarasa Rasiah told Malaysia Chronicle.

“The Attorney-General cannot expect us and the world at large to take his word as good that she had no access to the Investigation Papers or any information that could help Saiful.”

Case also hinges on Saiful’s credibility

Apart from possible unfair advantage, the sex scandal also casts a question mark on Saiful’s credibility as a key witness. This is an important point because the government’s case against Anwar hinges on Saiful’s testimony.

If the allegations are true, then Saiful would have cheated on his fiancee. Experts said such unreliability of character not only adds to the doubt already surrounding his testimony, but should render it void in the interests of justice and fair play to the person he has accused – Anwar.

“Saiful is accusing Anwar of having sodomized him. No one saw them – we only have Saiful’s word for it. And despite his having taken an oath in the mosque, Saiful has been found lying before. It is not the first time,” Siva said.

“So the question of morality cannot be evaded. There are serious questions about his character and his credibility as a witness especially with this latest affair. Before that, he denied meeting Prime Minister Najib Razak prior to lodging the police report against Anwar. Najib also denied meeting him, but when photos started to appear, both he and Saiful admitted to meeting in Putrajaya.”

Did Saiful cheat on his fiancee?

Both Saiful and Farah were already engaged to be married to respective partners. News has emerged that Farah broke off her engagement and allegations are rife it was because of Saiful.

Nonetheless, despite the possibility of gross misconduct, Anwar’s defense team led by Sankara Nair can expect to face tough resistance from both the court and the Najib administration.

In fact, many prominent civil society leaders, including lawmakers from United Kingdom, Canada and Australia, have already labeled the case a sham trial.Their criticism splashed all over cyberspace and the international press has shamed the country.

“The Najib administration will surely fight Anwar all the way. It is clear they want Anwar to lose. They want to lock him up and throw away the key,” PKR strategic director Tian Chua told Malaysia Chronicle.

“From day one, there was mala fide. They insisted on the trial even though there was no evidence of anal penetration, and till now, they are denying the defense access to key information in the case.”

Sodomy circus turns into a sex opera!

It seems that for the past few days the Attorney General (AG)’s Chambers have become somewhat like a boiler room after being hit by one steamy story after another. The AG, Gani Patail, has been going bonkers, berserk and ballistic, as a result of an unexpected hard blow below the belt by Raja Petra Kamarudin (RPK).

The famous whistleblower, lid-blower and blogger had dropped a bombshell by alleging that the AG has been bonking the head of one of his divisions.Such news blew many away but RPK said their sexploits were nothing new. Many in the AG’s Chambers have chosen to turn a blind eye to their boss’ bonking.

The AG and partner have allegedly saved the nation’s taxpayers money, as they would blissfully bunk, bonk and bond in the same hotel room during their frequent trips abroad.

We should not be bogged down by who is bonking whom, but when such basic or base instincts are allegedly displayed by the nation’s top legal officer it becomes the rakyat’s business!

This is especially so when the AG has been bonking from high moral ground of his Office whilst trying hard to banish Anwar Ibrahim into political oblivion with a bull-loaded sodomy charge.

Bonking Binge

The sex opera began with RPK alleging that the prosecution’s star witness in Anwar’s Sodomy II trial, Mohd Saiful Bukhar, was bonking Farah Azlina Latif, a deputy public prosecutor (DPP) involved in the case.

Was RPK bluffing? The AG begged not to comment but instead bundled Farah off to another division. Saiful and Farah bound themselves in silence, though Saiful could not stop babbling about the truth finally prevailing (and it really did!)

Anwar lodged a police report alleging that the “bonkers” had breached the law, especially the OSA. Karpal Singh, Anwar’s lead lawyer, said the couple, if innocent, should be bold enough to verify what they have been accused of. The Court was duty bound to allow him to question them in Court.

Karpal also blasted the AG’s Chambers: “Never before in the history of the country or in the Commonwealth has a DPP had an affair with the star witness”. The brave legal tiger forgot for a moment that he was inBolehland, where everything is beyond human comprehension!

The AG betrayed himself when he passed the baby on to Solicitor-General (SG) II Mohd Yusof Zainal Abiden, who told the court that the prosecution was totally blur on the bonking. He accused Anwar of making “bare allegations” and insisted there was no miscarriage of justice!

Karpal countered that Anwar had “bare facts” and “hard evidence” that the two had bared and bonked. He urged the Court not to go soft on the prosecution. The naked truth they could stand no more — is that their absolute lack of integrity has been exposed and credibility stripped to the very core!

The SG who was in the best position to respond to Anwar’s affidavit seeking the dismissal of the case, or require Saiful and Farah to file an affidavit, bewildered everyone by passing the buck to his subordinate DPP Hanafiah Zakaria and Investigating Officer (IO) Supt Jude Pereira.

As expected, the Court, which has been perceived by the general public as subserviently doing the bidding of the political masters, bowed and bent backwards, much to the pleasure of those in the AG’s Chambers.

Judge Zaibidin Diah found Anwar’s allegations of the Saiful-Farah’s sexual affair to be true but he ruled that the relationship did not compromise the case. He based this solely on the affidavits of the DPP and the IO. He rejected Anwar’s application to strike out the sodomy charge.

We are asked by the Court to believe that Farah, a qualified lawyer, chosen to be on the high-powered prosecution team, to assist in such a high-profile case, was merely a note-taker and beyond reasonable doubt was not privy to crucial information on the case!

Further, surely the learned judge knows that great empires have fallen when forbidden secrets were released by a lover during pulsating and passionate bonking moments and pillow talk. From the charge sheet and on to the bed sheet surely much would have been spilled!

As for DPP Hanafiah, Karpal told the Court that the DPP’s very own credibility was in question, alleging that the latter had had a second marriage in Thailand, and had tried to “legalise his marriage in Kota Bahru” and is therefore “guilty of committing an offence under the Syariah law”!

The IO had said that all investigation papers were strictly under his control. But who can trust the police nowadays? Even the Kota Kinabalu Sessions Court had described Jude Pereira’s boss, IGP Musa Hassan, “an incredible witness whose evidence is not to be believed”!

Monsters & Masterminds

The rakyat’s heart goes out to Janna Syariza, the fiancée of Saiful. Once when referring to the sodomy case, she had very bravely declared that she will stand by her man through the “monstrous battle that is looming ahead”, not realising that a “monster” was standing next to her.

RPK has also alleged in a blog posting “Just when you thought it is safe to go into the water”, that Saiful is also bonking Khairil Annas Jusoh, an aide of Najib. The man had proudly posed with the sodomy accuser outside the PM’s office when the latter went there “to apply for a scholarship”!

RPK revealed that after a one-month marriage, an on learning about the affair, Khairil’s wife left him and “divorce is certainly on the cards”. Will Janna Syariza, the fiancée of Saiful, be able to stomach and survive this third “storm”? She can be assured of the sympathies of many Malaysians.

One cannot but feel also for the fiancé of Farah who according to theMalaysian Chronicle is the assistant head of the prosecution unit in a northern state. They were engaged last year. Their marriage was due to take place on July 9.

A day before the marriage was due to be solemnized she asked for a cancellation, leaving her fiancé who had already sent out all the invitation cards stunned and heartbroken. Farah must have realized that she had gone too far!

Before we could even recover from the revelations of the shocking sex scandals of those who allow themselves to be used by the masterminds to destroy Anwar politically, RPK serves yet another sex sizzler and it involves the Attorney General himself!

Gani Patail must not remain silent. He must speak up and reveal whether it is just a spin (just like when almost everyone first thought that the Saiful-Farah sex liaison was one?). Not only his credibility and integrity is at stake, but also that of the Office of the Attorney General…and even the government!

Strangely enough the country’s self-appointed moralists and religious authorities have also been very silent on the sex fest that has taken place. There have been no screams or shouts of zina or khalwat or interviews and investigations to be conducted. Perhaps they have all grown up?

If such secret sex trysts are really going on amongst those in the Chambers of the AG what would be left of the public’s trust!

What is most surprising is that the accusations made so far is so general without any specifics. The AG has already blinked his eyes and jumped!!

Does the AG knows more than us the public and it took the allegation for him to jump? Is she going to come out with the statement that she was ordered to do be “Witness Relations Officer” so that the witness does not turn hostile?

Can we expect Chapter 2 and 3 and 4 to come from those who have made the allegations? Is the AG considering withdrawing the case? For if he does not, may be he may also become directly implicated in the affair?

Is this why the PM has decided to take a quick holiday to be far out of Saiful’s sight, in case he comes back fro more advice?

All these are quite intriguing for us concerned rakyat. We do not want to see a miscarriage of justice. Perhaps the poor sweet looking DPP girl is also a victim? Who knows? . We are all anxiously waiting for answers!!.
